聯合國大會近日曾就《經濟、社會、文化權利國際公約》中是否應包含禁止性傾向以及性別認同歧視的條文進行投票,但在一些國家的反對下,納入性傾向和性別身份反歧視條文的建議案以微弱的多數反對票被否決。
在這次有170多個國家的代表到場參加的全體投票中,旨在承認同性戀者等少數人群的存在、也保障這部分人群不因性傾向或性別身份而遭受歧視的重要國際公
約的補充文件,僅因幾票之差,而被刪除了相關內容。聯合國新近公佈的官方資料顯示了本次建議案的提出、辯論以及2009年12月18日最後投票的詳情。
2009年5月在日內瓦召開的聯合國經濟與社會理事會第四十二屆會議上,曾有部分國家提出了對《經濟、社會、文化權利國際公約》加以補充說明的建議案,該建議案在聯合國文檔中被列為關於經濟、社會和文化權利方面不歧視的“第20號一般性意見”。(注一)
由聯合國大會在1966年通過、也經許多國家簽署的《經濟、社會、文化權利國際公約》第二條第2款要求所有締約國“......保證,本公約所宣佈的權 利應予普遍行使,而不得有例如種族、膚色、性別、語言、宗教、政治或其他見解、國籍或社會出身、財產、出生地或其他身份等任何區分”。
這次提出的“第20號一般意見”認為,應明確對《公約》第二條第2款中關於“其他身份”的理解,包括明確締約國義務的範圍、禁止歧視的理由和國家落實。
這份一般性意見書第二部分“國家義務的範圍”下所列的“私人領域”部分說:“在家庭、工作場所以及其他社會部分,經常遇到歧視。例如,私人住房領域的主 管者(如私人房主、信貸提供者和公有住房提供者)可能出於族裔、婚姻狀況、殘疾或性取向等原因直接或間接拒絕提供住房或抵押,而某些家庭則可能拒絕讓女孩
上學。因此,締約國必須採取包括立法在內的措施,確保私人領域的個人和實體不因禁止的理由而歧視”。
關於《公約》第二條第2款中的“ 其他身份”表述,意見書認為,歧視的性質依環境和時間的變化而不同,需要靈活對待“其他身份”這一歧視理由,以便將那些可與第二條第2款明確承認的理由進 行比較的其他形式的差別待遇考慮進去。意見書說,這些額外理由可能反映了社會中曾遭受並仍在遭受邊緣化的脆弱群體的經歷。
意見書進一 步列舉和具體說明了可能遭受歧視的“其他身份”應包含的各種情況,並明確指出,《公約》第二條第2 款所承認的“其他身份”包括性取向以及性別認同。意見書認為,締約國應確保一個人的性取向不成為實現《公約》權利的障礙,例如,在行使倖存者撫恤金權利方
面。另外,性別認同也應被認定為禁止歧視的理由,例如,變性者的人權往往遭受嚴重侵犯,或在學校及工作場所被騷擾。
“第20號一般性
意見”由聯合國經濟與社會理事會向聯大提交,並被包含在聯大關於人權國際公約的決議案第十章中。基於這份意見書,《經濟、社會、文化權利國際公約》的簽約
國將有義務採取措施,包括制定相關法律,確保公民個人或團體免受包括基於性傾向和性別身份在內的各種歧視,保障同性戀者等群體在社會生活的各方面享有基本
的平等權利。(注二)
2009年12月18日,聯合國大會全體會議就人權國際公約的決議草案展開討論,這一決議內容包括關於《經濟、社會、文 化權利國際公約》的“第20號一般性意見”。在此之前,聯大的一個工作委員會已經投票通過了“第20號一般性意見”,但代表非洲部分國家的尚比亞又向相關 委員會提出建議,要求刪除“第20號一般性意見”中的性傾向相關條文和表述。非洲部分國家的這一建議被第三工作委員會投票拒絕採納。(注三)
但在12月18日聯大就有關決議投票前,代表阿拉伯國家的伊拉克又將非洲一些國家關於刪除性傾向條文的議案重新向聯大提出。伊拉克代表在提出其議案的聯大
發言中說,“第20號一般性意見”中納入的性傾向是“受到爭議的籠統概念”,而避免有關國際公約被“嚴重誤讀”是至關重要的。
在阿拉伯國家重新提出刪除性傾向內容的議案之後,“第20號一般性意見”支持國之一的芬蘭的代表發言反駁伊拉克代表說,在聯大決議中包含一般性的概念表述已是相當常見的事。芬蘭代表認為,基於性傾向的歧視是對世界上相當一部分人口的經濟、社會和文化權利的侵犯。
經過辯論後,聯合國大會就伊拉克代表發起的決議修訂案進行了全體投票,結果修訂案以76票贊成、72票反對和26票棄權的結果被通過,“第20號一般性意見”中的性傾向和性別身份相關條文被刪除,而關於人權國際公約的聯大決議隨後也獲得通過。(注四)
據聯合國公佈的投票詳情,絕大多數的非洲地區國家、以及伊斯蘭教國家對伊拉克所提修訂案投了贊成票,其他支持伊拉克議案的國家還有中國、古巴、北朝鮮、俄羅斯和南非等。
對伊拉克所提修訂案投反對票的除了歐盟、北美和澳洲國家外,也有日本、韓國、菲律賓、以色列、阿根廷、智利、哥倫比亞、多明尼加、厄瓜多爾、薩爾瓦多、
巴拉圭、烏拉圭、秘魯、洪都拉斯、巴拿馬、墨西哥等許多拉美或亞洲國家,而巴西、印度、尼泊爾、泰國和新加坡等國投了棄權票。另有少數國家的代表沒有參加

11. Also at the same meeting, the representative of Zambia, on behalf of the
Group of African States, orally proposed amendments to the draft resolution, by
which:
(b) In operative paragraph 10, the words “and takes note of the General
Comments adopted by the Committee, including the most recent, General Comment
No. 19 on the right to social security, and General Comment No. 20 on
non-discrimination in economic, social and cultural rights” would be deleted.
15. At the same meeting, the Committee rejected the proposed amendment to
operative paragraph 10 by a recorded vote of 72 to 71, with 23 abstentions. The

Also today, the Assembly overturned the Third Committee’s rejection of an oral
amendment to a draft resolution on the International Covenants for Human
Rights. Proposed in the Committee by Zambia on behalf of the African Group and today
by Iraq
on behalf of the Arab Group, that amendment eliminated a reference to General
Comment No. 20 on non-discrimination in economic, social and cultural rights,
which was issued earlier this year by the Committee on Economic, Social and
Cultural Rights.
In introducing the amendment, Iraq’s
delegate cautioned that including a reference to the general comment would
recognize controversial concepts on sexual orientation. It was paramount, he
said, to prevent international instruments from being “strangely interpreted”.
Arguing against the amendment, the representative of Finland said it was quite usual for
general comments to be noted in recent resolutions. Moreover, given the
comment’s opening statement -– that “discrimination undermines the fulfilment
of economic, social and cultural rights for a significant proportion of the
world’s population” -– she wondered if the Assembly was prepared to excise
reference to a comment that reiterated such an important principle. After the
amendment was passed by a vote of 76 in favour to 72 against, with 26
abstentions (Annex VI), the Assembly adopted the amended draft as a whole with
185 States in favour to none against, with no abstentions (See Annex VII).
